the music industry seems out of touch.

It seems that the music industry in general is either delusional or just plain foolish. They are pushing for payment even on the itunes 30-sec song sample. Seriously? If they charge Apple to preview the songs and Apple removes that feature, I can basically guarantee less songs will be sold. There's a reason people value the ability to browse books prior to purchasing and preview albums prior to purchase in store (no doubt they'd like a piece of that action too!). Of course with the RIAA's mysteriously nonfactual and blatantly one-sided curriculum for school children it's no wonder the music industry has such a distorted perspective of copyrights. Unfortunately for them, (provided that their indoctrination attempts fail... which I am fairly certain it will) this road is just going to alienate them from their consumers. The successes will continue to be those bands/labels that embrace the new media and innovate. Content industries have always been in crisis over technology shifts. The ones that survive are the ones that can at least meet the changes halfway.

Innovate or Fail.
